We hereby inform you, pursuant to Article 13 of Italian Legislative Decree 196/2003 (and subsequent amendments and supplements) that, within the commercial relationship with our Company, D’Amico Società di Navigazione S.p.A., hereinafter DSN, manages a range of personal data concerning the company/firm you represent.

 

PURPOSES OF PROCESSING

The personal data shall be processed for the purpose of managing your commercial relationship (contractual management). Furthermore, some data may be used for business management control and statistical purposes.

More specifically, personal data may be processed in order to:

  • fulfil contractual obligations towards the data subject;
  • fulfil legal tax obligations;
  • comply with the public procurement rules set forth in Italian Legislative Decree 50/2016 and subsequent amendments and supplements;
  • comply with the rules on the traceability of financial flows set forth in Italian Law 136/2010 and subsequent amendments and supplements.

 

PROCESSING PROCEDURES

These data shall be processed using computer-based (including where necessary, electronic forms) and paper-based tools, in compliance with the rules on personal data protection, including those concerning data security.

 

MANDATORY OR OPTIONAL NATURE OF DATA DISCLOSURE

Many of the data processed are necessary in order to execute the obligations arising from legislation and to fulfil respective contractual obligations. Hence, failure to consent to their processing could mean that DSN is unable to pursue the contractual relationship established.

Pursuant to Article 24(1)(A) and (B) of Italian Legislative Decree 196/2003 and subsequent amendments and supplements, consent to the processing of the aforesaid data is not necessary as the data have been collected to comply with legal obligations and/or to execute obligations arising from the contract in place or so-called pre-contractual obligations.

 

CATEGORIES OF PERSONS TO WHOM THE DATA MAY BE COMMUNICATED

The data you provide may be communicated to public and private operators of relevance for the aforesaid purposes.

The personal data shall be communicated on the basis of obligations established by law and by special mandates granted by data subjects (for example, crediting of payments at banks). In this regard personal data are communicated to Credit Institutions.

Your data may also be communicated to persons appointed by DSN as external Data Processors for the following purposes:

  • Administrative-accounting and tax management.

Furthermore, the Agency continues to be under obligation to communicate the data to the Judicial Authority, whenever such a request is made.

DATA PROVIDED VOLUNTARILY BY THE USER

The data provided during the recruiting process shall be processed by authorised persons using manual, computer and electronic tools and exclusively for personnel search and selection purposes, so as to guarantee their security and confidentiality. For the same purposes, the data may be communicated to other companies of the d’Amico group, they shall be stored in the corporate archives for a maximum of 2 years and then they shall be deleted.
